No, you can get it when you race that Grease Guy, or you can check around the area I said about. It's not their all the time though, it spawns randomly so it's best to check on it every time you pass their.

thanks for the help I got it I found if you get a wanted star its appears there for some reason...

Well, if you did get in the car, most expectedly you'd get a wanted level on you, I believe since it's parked near the pavements, which means that Cops could be walking around.
